“…The above conclusion is manifestly unimpeachable and I am unable to disturb same. Section 1(1) of the Dishonoured Cheques Offences Act makes it an offence for any person to obtain credit for himself by means of a cheque that when presented for payment not later than three months after the date on the cheque, it is dishonoured on the ground that no funds were standing to the credit of the drawer of the cheque.

The evidence on record shows quite clearly and I agree in this regard with the learned trial judge that it is the expectation of the Appellant that the cheques issued to the complainant, particularly the one for N10 million, was issued with the expectation that it would not be honoured, having regard to the fact that the lack of funds in the 2nd Defendant’s account to accommodate the value of the cheque.
