LAGOS 2019 CIVIL PROCEDURE RULES – LAGOS NBA MAY HEAD TO COURT

The Lagos NBA, on Wednesday 30th day of January 2019 held an Extra Ordinary General Meeting(EGM) to deliberate on the High Court of Lagos State (Civil Procedure) Rules 2019 which was recently unveiled by the Chief Judge of Lagos.

After deliberation by members with contributions from senior members of the Branch it was resolved as follows –

1. The Executive Committee of the Branch should liaise with the Executive Committee of the other Branches and hold a press conference.

2. The Branch’s Judiciary Committee which submitted the Branch’s memorandum to the High Court Rules Committee should continue to engage the Chief Judge of the state on the rules after reviewing the rules on the provisions that do not aid the promotion of justice.

3. There was a unanimous agreement that the Chief Judge is empowered to make rules and that the power cannot be challenged but if there is any provision in the rules that can be challenged then same should be challenged.

4. The Judiciary Committee should look at the provisions of the rules and see if there is any legal basis for a court action.
