FOI: COURT GRANTS NGO’S REQUEST TO SUE PETROELUM EQUALIZATION FUND

In the case of Registered Trustees of Citizens Awareness against Corruption (CAAC) and Petroleum Equalization Fund (PEF) (suit N0: FHC/ABJ/CS/52/2021) the Federal High Court sitting in Abuja has ordered the applicant to proceed to file an application for judicial review against Petroleum Equalization Fund (PEF) for failure to disclose public information to the applicant as requested. The applicant on 16th day of December 2020 sent an FOI request to the PEF seeking for CTC of nominal role of payment (positions and salary) and certified true copy of approvals for recruitment and evidence of job advertisement between 2015 to 2020.

The motion was argued by President Aigbokhan, Esq of FOI Counsel. FOI counsel supports NGOs in Nigeria by way of research, advocacy and litigation support. The organization has assisted with legal support (pro bono) for NGOs in Nigeria and has a published book titled “Freedom of Information Law, Practice and Procedure” which is available in all bookshops in Nigeria

Hon. Justice A. I. Chikere in its ruling granted the application and fixed the motion on notice for 22nd day of February 2021 for hearing. The Defendant has since been served with the motion
